Copyright & DMCA Policy

This policy outlines how Real Public School protects intellectual property rights, the ownership of user-generated content, and the procedure for submitting copyright infringement takedown notices under the Digital Millennium Copyright Act (DMCA) and applicable copyright law.

1. Introduction

Real Public School respects the intellectual property rights of others and expects all users of the platform to do the same. This policy explains how we handle copyright matters, the ownership of content on the platform, and the process for reporting copyright infringement.

This policy applies to all content uploaded, shared, or published on the Real Public School management platform, including documents, images, videos, notices, homework materials, and any other files or content.

2. Intellectual Property Rights

Intellectual property rights include copyright, trademarks, patents, and other legal protections for creative and original works. On this platform, the most relevant form of intellectual property is copyright, which protects original works such as:

  • Written materials (textbooks, articles, lesson plans, worksheets)
  • Images, photographs, and illustrations
  • Videos and audio recordings
  • Software and computer programs
  • Databases and compilations
  • Student and teacher original work

Copyright protection arises automatically upon creation of an original work. Users do not need to register their work to hold copyright in it.

3. School-Owned Content

The following content is owned by or licenced to Real Public School and is protected by copyright and other intellectual property laws:

  • The Real Public School name, logo, and branding
  • The platform's software, design, and user interface
  • Official school notices, circulars, and announcements created by school staff
  • School-created templates, forms, and administrative documents
  • Any other content created by or on behalf of Real Public School

Users may not copy, reproduce, distribute, or use school-owned content outside the platform without the prior written permission of Real Public School.

4. User-Generated Content Ownership

Users retain ownership of the original content they create and upload to the platform. This includes:

  • Student homework, assignments, and project submissions
  • Teacher-created lesson materials, worksheets, and resources
  • Original documents, images, and files uploaded by users

By uploading content to the platform, users grant Real Public School a limited, non-exclusive, royalty-free licence to store, display, and share the content with authorized users within the platform for the purposes of school operations. This licence does not allow the school to use user content for commercial purposes or to share it outside the platform without the user's consent.

Your Content, Your Rights

You retain ownership of the original content you create and upload. The school only uses your content to operate the platform and provide school services to you.

5. Prohibited Infringing Activity

The following activities are strictly prohibited on the platform:

  • Uploading, sharing, or distributing copyrighted content without authorization from the copyright owner
  • Reproducing or copying textbooks, articles, or educational materials in violation of copyright law
  • Uploading copyrighted images, music, or videos without a valid licence
  • Submitting plagiarized work as original student assignments
  • Removing or altering copyright notices from content
  • Using the platform to facilitate copyright infringement by others

Copyright Infringement

Uploading or sharing copyrighted content without authorization is a serious violation of this policy and applicable law. Violations may result in account suspension and legal action.

6. DMCA & Copyright Law Overview

The Digital Millennium Copyright Act (DMCA) is a United States copyright law that provides a process for copyright owners to request the removal of infringing content from online platforms. While Real Public School operates primarily in India and is subject to Indian copyright law (the Copyright Act, 1957), we follow a similar notice-and-takedown procedure for copyright complaints.

If you believe that content on the platform infringes your copyright, you may submit a takedown notice as described below. We will respond to valid notices promptly and in accordance with applicable law.

7. Submitting a Takedown Notice

To submit a copyright infringement takedown notice, please provide the following information in writing to our designated copyright contact (see Section 12):

  1. Your identification: Your full name, address, telephone number, and email address
  2. Description of the copyrighted work: A description of the copyrighted work you claim has been infringed, including the URL or location of the original work if available online
  3. Location of the infringing content: A description of the infringing content on our platform and its URL or location, sufficient for us to identify and locate it
  4. Good faith statement: A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law
  5. Accuracy statement: A statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on behalf of the copyright owner
  6. Signature: Your physical or electronic signature

False Notices

Submitting a false or misleading takedown notice may expose you to legal liability. Please ensure your notice is accurate and made in good faith.

8. Counter-Notice Procedure

If you believe that content you uploaded was removed in error or as a result of a mistaken or invalid takedown notice, you may submit a counter-notice. Your counter-notice should include:

  1. Your full name, address, telephone number, and email address
  2. Identification of the content that was removed and its location before removal
  3. A statement under penalty of perjury that you have a good faith belief that the content was removed as a result of mistake or misidentification
  4. A statement that you consent to the jurisdiction of the relevant courts and will accept service of process from the person who submitted the original takedown notice
  5. Your physical or electronic signature

Upon receipt of a valid counter-notice, we will forward it to the original complainant and may restore the removed content after a reasonable waiting period, unless the complainant informs us that they have filed a legal action.

9. Response Timeframe

Real Public School is committed to responding to copyright complaints promptly:

  • Acknowledgement: We will acknowledge receipt of a valid takedown notice within 2–3 business days
  • Initial review: We will complete an initial review of the notice within 5–7 business days
  • Content removal (if applicable): Where a notice is found to be valid, we will remove or disable access to the infringing content within 10 business days of receipt of the notice
  • Counter-notice processing: Counter-notices will be processed within 5–7 business days

Response times may vary depending on the complexity of the complaint and the volume of notices received. We will keep you informed of the status of your complaint.

10. Repeat Infringers

Real Public School has a policy of terminating, in appropriate circumstances, the accounts of users who are repeat infringers of intellectual property rights. A user may be considered a repeat infringer if they have received multiple valid takedown notices or have repeatedly uploaded infringing content.

The school reserves the right to suspend or terminate the account of any user who repeatedly violates this policy, without prior notice.

11. Fair Use & Educational Use

Copyright law in many jurisdictions, including India, provides for exceptions that allow limited use of copyrighted material without the copyright owner's permission in certain circumstances, including for educational purposes. These exceptions are sometimes referred to as "fair use" or "fair dealing."

However, these exceptions are limited and do not permit unlimited copying or distribution of copyrighted material. Users should not assume that all educational use of copyrighted material is automatically permitted.
